OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. PROMOTION
DATES
a. The
VOICE OF THE VALLEY 2008 (“Promotion”) will begin on JUNE 30TH,
2008 AT 12:01 A.M. ET and end on AUGUST 16TH,
2008 AT 8 P.M. ET.
2. ELIGIBILITY
RESTRICTIONS
a. The
Promotion is open to all legal residents of the United States and the
District of Columbia (except NY and FL) who are 18 years of age or
older at the time of entry and who live in WHSV’S SERVICE AREA OR
NEILSEN DMA. Employees of WHSV (the “Station”), its corporate
parent, subsidiary, and affiliated entities, its advertising
agencies, participating sponsors/promotional partners, other
broadcasting stations in the Harrisonburg,
Staunton, Waynesboro or Charlottesville
metropolitan areas, and the members of their immediate families
(spouse, parents, siblings or children) or households are ineligible
to participate or win. This Promotion is subject to all applicable
federal, state, and local laws and regulations. Void outside the
United States, in NY and FL, as applicable, and where prohibited.
b. Only one winner per household is permitted in any Station contest/sweepstakes.
c. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3. ENTRY
a. To
participate in the Promotion, you may enter via the following
method(s):
VIA INTERNET – All contestants must complete an official contest entry form. The form can be found on www.whsv.com/voice. Contestant must download and complete the form, then return it via email to voice@whsv.com or via mail at “Voice Of The Valley, 50 North Main Street, Harrisonburg, VA 22802. Contestants may submit their music entry in mp3 format via email to voice@whsv.com. MP3 entries may be no larger than 10MB in file size. Entries and contest forms must be received by WHSV no later than August 1st, 2008. Follow the links and instructions to enter and submit your first name and last name, complete address, city, state, zip code, telephone number, date of birth, and a valid email address in the online entry form. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning the email address or the domain associated with the submitted email address. Multiple entrants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. The contest/sweepstakes administrator’s computer is the official time keeping device for the Promotion. For purpose of this Promotion, a “Day” shall begin at 12:00:00 a.m. ET and shall end at 11:59:59 p.m. ET.
VIA POSTAL MAIL – Contestants may submit their music entry via postal mail at “Voice Of The Valley, 50 North Main Street, Harrisonburg, VA 22802”. Postal mail entries must be submitted on standard cassette tape or compact disc. If entry is not playable on WHSV’s designated audio equipment, entry will be disqualified without notification. Each entry by mail must include the entrant’s first name and last name, complete address, city, state, zip code, telephone number, and date of birth. Mailed entries must be accompanied by a completed contest entry form, which can be found on www.whsv.com/voice. Entry forms may also be picked up in person at WHSV’s Harrisonburg studio during business hours from 8:30 a.m. to 5 p.m., weekdays only. Entries and contest forms must be received by WHSV no later than August 1st, 2008.
VIA LIVE WILDCARD ROUNDS – Should you not be chosen as one of the Top 3 Demo Selections, you may enter the Voice Of The Valley Wild Card Rounds held nightly at the Rockingham County Fair, August 11 through August 14, at the See-Mor Talent Pavilion. There will be two Wild Card rounds per night. The first starts at 7:15, the second at 9:15. Registration for each Wild Card Round will will begin 30 minutes before the contest begins and entrance forms will be be filled out then. Time only allows a maximum of 8 contestants per round, so come early – FIRST COME, FIRST SERVED. Contestants must be present to fill out the Contest Entry Form themselves. The contestant receiving the most points in each of the Wild Card Rounds will advance to the Wild Card Finals which will be held August 15 starting at 5:45 PM. You may enter as many Wild Card Rounds as you like if you are not chosen as a winner. The top two contestants from the Wild Card Finals will advance to the Voice Of The Valley Finals held the following night.
4. PRIZES
a. The
1st place winner of Voice Of The Valley will receive 20 free hours of
studio time awarded by Alive Studio in Harrisonburg, VA. The
2nd place winner will receive 10 hours of studio time. The
third place winner will receive 5 hours of studio time. Each
contestant who enters will receive 1 hour of free studio time.
Also,
a CD will be produced for MRC Records with
2 songs performed by each of the 5 contestants in the Voice Of The
Valley Finals. Studio time must be booked before December 31,
2008.
b. There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
5. WINNER
SELECTION AND NOTIFICATION
a. Decisions
of Station management with respect to the Promotion are final.
b. Winners
will be announced on WHSV News 11@11 on Saturday, August 16th
between 11:00 p.m. and 11:35 p.m.
c. Performances during the Wild Card Rounds will be awarded 0-10 points in each of the following categories: 1) Marketability in music; 2) Vocal ability; 3) Stage presence/charisma; 4) Audience response measured by VU meter, most response receiving 10 points, second receiving 9, third, 8, etc. In the Voice Of The Valley Finals, 7.5 points will be awarded to the highest vote getter chosen by counting ballots at the fair and 7.5 points to the contestant receiving the highest votes on the WHSV web site. Second most votes will receive 6.5 points, etc: An optional bonus of up to three points may be awarded for acts performing their own music. In the event of a tie, the first tie-breaker shall be the highest number of points given in the Vocal ability category. The second tiebreaker shall be the highest number of points awarded in the Stage Presence/Charisma category. The third tiebreaker shall be by a secret vote of the judges based on overall performance style and impact.
d. Dressed rehearsal will be held on August 16th, 2008. Finalists will be notified of the rehearsal time once it has been established. Finalists who fail to attend the dressed rehearsal will be disqualified at the sole discretion of WHSV. Finalists who fail to arrive at finals location after 6 p.m. on August 16th, 2008 will be disqualified at the sole discretion of WHSV.
e. Winners will be notified via telephone no later than Tuesday, August 20th, 2008. Winners (or their parents or legal guardians if under the age of majority) must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of notification attempt or winner will be disqualified and the prize will be forfeited and an alternate winner – the individual with the second highest finals score. If a potential winner cannot be contacted, fails to complete, sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner will be disqualified and will forfeit the prize.
g. Winners must book their studio time no later than December 31st, 2008. The Station, its sponsor, or promotional partner are not responsible for the safe arrival of a prize or prize certificate.
6. CONDITIONS
a. Payments
of all federal, state and local taxes are solely the responsibility
of the winners. Winners will be required to complete and submit an
IRS Form W-9 or the equivalent including the winner’s full Social
Security Number for receipt of any prize valued at $600 or more or
for any prizes awarded by the Station in a calendar year with an
aggregate value of $600 or more. Failure to submit a complete W-9 or
equivalent will result in disqualification and forfeiture of the
prize.
b. By participating in the Promotion, each winner agrees to have his or her name, city, state, voice, or likeness used in any advertising or broadcasting material relating to this Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the contest, the Station in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification. By participating in the Promotion, each winner agrees to release hold the Station, its sponsor(s) and promotional partner(s), and each of their parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents and representatives of each of them (collectively, the “Released Parties”) harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion. The Station will also require eligible Promotion winners and their guests or travel companions, if any (as well as each of their parent(s) or legal guardian(s), if winners, guests or travel companions are under the age of majority in their state of residence), to sign a liability release confirming such consent.
d. The Station, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or the operation of the Station’s web channel or is otherwise in violation of the rules. The Station further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Station’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by the Station in is sole discretion. Any attempt by an entrant or any person to deliberately damage any station web channel or to undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws. Should such an attempt be made, the Station reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law. The Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to modify, suspend or cancel the Promotion and shall not be required to award a substitute prize.
e. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals; or (iii) lost, stolen, mangled, misdelivered, postage due, illegible, incomplete, incorrect, or late entries.
f. To obtain a copy of the Official Rules or a list of winners following completion of the Promotion (please specify which), send a self-addressed, stamped envelope (VT residents may omit return postage) specifying “Official Rules” or “Winner List” to Voice Of The Valley 2008 Winner List or Official Rules Request, WHSV, 50 North Main Street, Harrisonburg, Virginia, 22802. A copy of the Official Rules and a list of winners (when complete) are also available during regular business hours at the main studio of WHSV, 50 North Main Street, Harrisonburg, Virginia, 22802. All such requests must be received within thirty (30) days following completion of the Promotion.
e. Each
act entered in Voice Of The Valley must perform only with the
personnel listed on the Entry Form. No personnel changes or
substitutions will be permitted once competition has begun. Once an
individual withdraws from an act, he/she cannot perform in this years
contest
f. Individuals may perform with only one act.
g. Pony Express will be provided as a backup band for acts requiring
instrumental support or contestants will be allowed to use
pre-recorded music. Bands may only perform vocally. There is
not enough time to set up stage gear for a band and Pony Express gear
is not an option. Individuals may accompany themselves on an
instrument.
h. Neither the backup band nor any of its members
is permitted to compete in the contest.
i. Each act must
perform live, vocally and/or instrumentally. No special lighting,
props or special effects may be used.
j. The amount of
performance time given to each local Showdown contestant will be
determined by WHSV.
k. All performances must be done in good
taste: no music or lyrics that WHSV or Alive Studios consider to be
offensive may be performed.
l. Contestants may perform their
own music and receive extra bonus points from the judge. Music
eligible for bonus points will be defined as any piece of music
written or co-written by the contestant (either individual or member
of group). Any contestant (either individual or member of group) who
claims to be using his own music may be disqualified at the
discretion of TV 3 and Alive Studio, if a musical copyright for the
music exists which does not name the contestant as author or
co-author.
m. Acceptable documentation to prove ownership of
your music shall include either a certificate of copyright, proof of
song registration with BMI, ASCAP, etc., or a notarized copy of the
application applying for the copyright with a signed statement by the
contestant as to its status.
n. Contestants must
perform a different song for each performance.
o. Contestants may be disqualified immediately from the Voice Of The Valley competition if the act (or any member thereof) commits any act or becomes involved in any situation that would adversely reflect on WHSV, Alive Studio or any party furnishing a prize, or tend to bring it into public disrepute.
7. DISPUTES:
a. R
& L Productions and WHSV are authorized to resolve all disputes
at the Voice Of The Valley Contest. R & L and WHSV
will
disqualify any contestant for failure to comply with the
rules
and regulations, including errors and omissions. The decisions of
WHSV and R & L Productions are final.
8. ASSUMPTION
OF RISK:
a. By
submitting this entry form, the act (and each individual member
thereof) assumes all risks of property damage or bodily injury
(including death) that might occur during the contests events. The
act (and each individual member thereof) agrees not to bring against
WHSV, Alive Studios, Robby Meadows Studio Productions, R & L
Productions, or other sponsors any claim for property damage or
bodily injury (including death) that might occur during contest
events
9. TERMS
OF USE AGREEMENT & PRIVACY POLICY
a. By
use of this web channel and by entering this Promotion, you agree to
the Station’s Terms of Use Agreement and to the use of your
personal information as described in the Privacy Policy located at:
